According to legend, the colours come from a free-corps during the Napoleonic wars. It consisted of mostly of students. At that time and under the impression of foreign rule, the idea of a unified Germany fist evolved. The free-corps wore black coats with golden brass buttons and red symbols their blood that was spilled for liberty from Napoleon. In 1848, it became the colours of the first free (and short lived) parlament in Frankfurt and patriotic student fraternities who wished for a united Germany chose it for their colours. I can't remember which was first. After the German Empire was formed, german-nationalist Austrian students used the colours (and still do) to show their association with Germany, in contrast the usually pro-Habsburg catholic students used colours associated with the Habsburgs Monarchy like black and gold/yellow.
